Liability Release Waiver

LIABILITY RELEASE WAIVER CRICNETS Ltd. Unit 120/110 – 675 Queen St S., Kitchener, ON N2M 1A1 The Releasor hereby releases, waives, and forever discharges the Releasee from any and all liability, claims, or demands. This Liability Release Waiver ("Waiver") applies to all activities conducted at or organized by CRICNETS Ltd. ("CRICNETS"), including but not limited to cricket, baseball, softball, training sessions, coaching, gym use, batting cages, pitching machines, table tennis, tournaments, leagues, camps, practices, matches, events, and all related activities at any CRICNETS location or any alternate location organized by CRICNETS. By signing this Waiver or electronically accepting it during online registration or booking, the participant acknowledges and agrees to the following: 1. Voluntary Participation and Assumption of Risk I understand and acknowledge that participation in sports and recreational activities involves inherent risks, dangers, and hazards, including but not limited to bodily injury, serious injury, permanent disability, concussion, paralysis, property damage, illness, and death. I voluntarily choose to participate in these activities and fully assume all risks, known or unknown, foreseeable or unforeseeable, associated with participation and attendance at CRICNETS facilities or events. 2. Inspection of Facilities and Equipment I agree that prior to participating in any activity, I will inspect the facilities, playing areas, equipment, and surroundings. If I observe any unsafe condition or hazard, I will immediately notify CRICNETS management or staff and refrain from participation until the issue is addressed. 3. Responsibility for Injuries and Damages caused by Negligence I acknowledge that injuries or damages may result from my own actions or negligence, the negligence of other participants, improper use of equipment, facility conditions, unsupervised activities, physical contact with players or objects, operation of pitching or bowling machines, slips, falls, collisions, or other sports-related incidents. I accept full personal responsibility for any injuries, losses, damages, or expenses that may arise from my participation, including those caused in whole or in part by the negligence of any released party to the fullest extent permitted by law. 4. Release of Liability To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless CRICNETS Ltd., its owners, directors, officers, employees, coaches, trainers, staff, volunteers, contractors, sponsors, affiliates, landlords, and agents (collectively, the "Releasee") from any and all claims, liabilities, demands, actions, damages, costs, or expenses (including those arising from negligence) related to personal injury, property damage, loss, disability, medical expenses, or death resulting from participation in any CRICNETS activity. 5. Medical Authorization and Expenses In the event of an emergency, accident, or illness, I authorize CRICNETS staff to obtain emergency medical treatment on my behalf, including ambulance transportation and hospital care if deemed necessary. I authorize physicians, nurses, trainers, technicians, first-aid personnel, and other medical professionals to provide necessary medical care, diagnostic procedures, treatment, and emergency services. I understand and agree that CRICNETS does not provide medical insurance coverage, I am solely responsible for maintaining my own medical and liability insurance coverage, and I accept full responsibility for all medical costs and related expenses. 6. Team Captains, Coaches, Booking Organizers, and Parents A coach, team captain, organizer, parent, or the individual who makes a booking on behalf of a team or group may arrange registrations, payments, coaching sessions, or facility bookings for participants; however, each individual participant is personally responsible for reviewing and accepting this Waiver prior to participating in any activity. No coach, team captain, organizer, parent, or booking individual may waive or release legal rights on behalf of another adult participant unless specifically authorized by law. For participants under 18 years of age, a parent or legal guardian must review and accept this Waiver on the minor's behalf before participation is permitted. The individual making the booking is responsible for ensuring that all participants associated with the booking have completed and accepted the required waiver before entering or using the facility. Parents, guardians, private coaches, trainers, or organizers conducting independent coaching, training, or supervision of minors under their booking acknowledge and agree that they are solely responsible for supervising the participating minors, ensuring safe conduct and instruction, monitoring equipment usage, and the safety and well-being of the participants under their care. CRICNETS does not provide direct supervision unless specifically agreed to in writing. Parents, guardians, and private coaches assume full responsibility and liability for the minors participating under their booking or supervision. 7. Future Participation and Continuing Waiver I acknowledge and agree that this Waiver applies to all current and future visits, bookings, practices, games, tournaments, events, and activities at CRICNETS unless revoked or replaced in writing by CRICNETS. CRICNETS may require updated waiver acceptance periodically, including annual renewals or whenever facility rules or activities change. 8. Electronic Signatures and Online Acceptance I acknowledge that electronic acceptance of this Waiver, including checkbox acknowledgment, typed signatures, online registration acceptance, or digital booking confirmation, shall have the same legal effect as a physical handwritten signature. 9. Compliance with Rules I agree to follow all CRICNETS rules, policies, safety instructions, posted signage, and staff directions. Failure to comply may result in removal from the facility without refund. 10. Acknowledgment of Understanding I confirm that I have carefully read this entire Waiver, I fully understand its contents, I understand that I am giving up certain legal rights, and I voluntarily agree to all terms and conditions stated herein. By signing below or electronically accepting this Waiver, I acknowledge that I understand and accept all risks associated with participation at CRICNETS.
